Colby Nielsen was in tears after his newborn daughter was taken from him this month, only weeks after she was born. Although he was listed as the child's biological father, Utah law allows a child to be put up for adoption without knowledge or consent of the biological father. Nielsen's lawyer, Wes Hutchins thinks what happened to Nielsen was a travesty. "They took this man's daughter without his knowledge or consent," Hutchins told Salt Lake City's Fox 13. "That is essentially, by definition, stealing.”
Senator Todd Weiler told Fox 13 that he was saddened by Nielsen's situation, but the law had been in place for decades. “In this case it's a heartbreaking story, but a simple Google search would've told this father the steps he needed to take,” Weiler said.
Hutchins told Utah's KUTV that the fight was not over. "We are going to aggressively pursue his rights, and we are going to do so on an expedited basis.”
